Going through a divorce can be difficult, as you need to think about the patrimonial consequences, division of assets, care and contact of minor children as well as major dependent children, spousal maintenance, pension funds, debt etc.

If parties are in agreement with the above, then the divorce can be finalized on an unopposed basis. Parties will have to enter into an agreement known as a consent paper or settlement agreement which will be incorporated in the decree of divorce. This route is quicker and less cost effective.

If parties cannot reach an agreement, then one of the parties can start the divorce proceedings by drawing up a summons and having it served on the other party. If summons is defended then this is known as an opposed divorce which generally takes longer to finalize and will cost more.
